Amendment to the General Retail Industry Award
Casual conversion effective from 1 October 2018
15 August 2018
Members are advised that the Fair Work Commission has released the start date for casual conversion. From 1 October 2018 an employee who is employed on a regular, casual basis will have the right to request that their employment be converted to permanent full time or part time employment.
The casual employee must have been employed as a regular employee for at least 12 months and have a pattern of hours on an ongoing basis. The request must be in writing and the employer is able to refuse the request on reasonable grounds, after consultation with the employee. Where the employer refuses the request for conversion, the reasons for the refusal must be given to the employee in writing within 21 days of the request. If the employee does not accept the employer’s refusal this will constitute a dispute and either party may refer the matter to the Fair Work Commission for resolution.
MGA TMA will shortly release a detailed Information sheet for members use.
